While there are many positive reasons for a person to own their own business and work from home, having a home business can also be overwhelming at times. Every business owner must deal with legal issues and home business owners are not exempt. This article talks about what a home business owner needs to do to keep their home business legal.

Getting a business license

Depending on where the home business owner lives, they will be required to do and have different things. Many cities will require a home business owner to receive a business license and to be registered with their city hall. Other places will want home business owners to pay a certain amount of money to have their business in their home. Whatever the requirement, it is important that a home business owner find out at their city hall.

Employer Identification Number

A home business owner will need to have a Tax ID or an Employer Identification Number (EIN) if they plan to have employees. If a person does not have any employees then they will most likely be able to just use their Social Security Number instead of getting an Employer Identification Number.

Registering with the state

A home business owner can keep their home business legal by registering their business with the state. Home businesses need to register with the state for both liability and tax reasons. First they will need to figure out what type of business their home business is. Once they have determined this they can then fill out the paper work needed for their type of business.

A state sales tax and resale tax certificate

A home business owner needs to get a state sales tax certificate so that they can sell their goods. And since home business owners are required to pay some of what they earn to their state, it is also helpful for them to get a resale tax certificate. This way, if the home business owner buys their products at a wholesale price to use in their products, they will not have to pay the taxes two times.

Zoning

Some areas do not allow businesses and if this is the case a home business could be shut down. There are also different rules that may limit the amount of customers that a home business can have in a day. It is important for a home business owner to find out about and follow the local zoning laws. A home business owner can do this by contacting their city hall.

Each city and state has different tax requirements and laws for home businesses. To find out the requirements, a person should contact a local accountant who would be familiar with the tax rules. It is also helpful for a home business owner to keep a credit card and a bank account that is for their business only. This can help them to keep better documentation of the home business' financial record which can make it easier on the home business owner when it comes time to deal with taxes.

Keeping licenses and permits up-to-date

When a person is running a business from their home, keeping their licenses and/or permits up-to-date is a great way to keep their home business legal. Each type of license and permit has different expirations and requirements. A home business owner should be familiar with these requirements, when their license or permit is set to expire, and what exactly they need to do to renew it or keep it up-to-date.
